Aceves v. U. S.
Bank, California appeals court decision
that bank's oral promise to work with borrower
on a loan modification IS enforceable if the
borrower relies on that promise and changes
his/her position based on that reliance. In
other words, if the bank told the borrower the
truth about foreclosure going full steam ahead
despite the loan modification request, would
the borrower have done anything
different? If so, then the oral promise
by the bank is enforceable, and foreclosure was
wrongful.
